General Terms and Conditions for Events
1. Scope
1.1 The following General Terms and Conditions apply to all legal transactions entered into by the Organizer with its contractual partner under this agreement, hereinafter referred to as the “Participant”, unless individual events are subject to different provisions. Any such provisions will be listed separately on the relevant event pages.
1.2 SAW Tagungsmanagement acts on behalf of and in the name of its client, the initiator of the event. Accordingly, these General Terms and Conditions form part of the contract concluded between the Participant and the Organizer, regardless of whether SAW or the initiator is the Organizer in the sense of the economic sponsor.
1.3 Amendments to these Terms and Conditions will be notified to the Participant in writing. They will be deemed accepted unless the Participant objects in text form. The Participant must send any objection to the Organizer within 2 weeks of being notified of the amendments.
2. Subject of the Contract
2.1 The Organizer offers conferences, continuing education courses and seminars. A detailed description and list of services offered will be made available by the Organizer, including at its business premises, on its website and through other media it uses.
2.2 The basic subject of the contract/description of services:
Participation in an event offered by the Organizer.
3. Conclusion of the Contract
3.1 A contract with the Organizer is concluded when the Participant registers online, by email, or by verbal agreement followed by submission of a written declaration of participation.
3.2 Upon receipt of their declaration of participation, each Participant will receive a confirmation or rejection letter.
3.3 The declaration of participation is binding and may, unless otherwise specified in the special event terms and conditions, only be cancelled up to 14 days before the event begins, subject to payment of a processing fee of EUR 35.
3.4 For group registrations, the Organizer enters into a participation agreement for and on behalf of the group with the person responsible for the Participants or authorized to issue instructions. This agreement is also binding.
3.5 The Organizer reserves the right to cancel or terminate the event up to 4 weeks before it begins, after exhausting all available options, if holding the event is unreasonable because registration numbers are so low that the resulting costs would exceed the financial burden the Organizer can reasonably be expected to bear.
3.6 The Organizer may exercise its right to withdraw only if it can demonstrate the circumstances leading to the withdrawal and has offered the Participant a comparable alternative. Any participation fee paid will be refunded without delay.
4. Contract Term and Fees
4.1 The contract begins and ends at the specifically agreed individual times.
4.2 Payment terms: The participation fee for each event is based on the Organizer’s current price list at the time the contract is concluded.
The Participant may meet their payment obligation by:
Credit card
Bank transfer
Invoice
Direct debit
Cash at the conference office
4.3 All payments are due within 14 days of invoicing, without deduction. If payment deadlines are exceeded, the Organizer is entitled, without further notice, to default interest of 2% above the European Central Bank reference rate, in accordance with the Discount Rate Transition Act. The right to claim any further damages remains unaffected.
4.4 Out-of-pocket expenses and special costs incurred by the Organizer at the Participant’s express request will be charged at cost.
4.5 Depending on the event, all services provided by the Organizer are exclusive/inclusive of the statutory VAT, currently 19%.
5. Scope of Services and Services Not Used
5.1 The scope of services is determined by the relevant contract between the Organizer and the Participant.
5.2 If a Participant does not use individual services, the Organizer reserves the right to charge the full participation fee. This does not apply if the Participant can prove that no damage, or only minor damage, was incurred.
6. General Conditions of Participation
6.1 A Participant is in breach of the contract if, despite being formally warned, they persistently disrupt the event, or behave in a manner seriously contrary to accepted standards of conduct, preventing the event from running smoothly. In such cases, the Organizer reserves the right to exclude the Participant from the event and to charge the participation fee. The Participant may provide evidence that the costs incurred were lower.
6.6 Before the event, the Organizer must be informed of any health problems or illnesses so that the Participant concerned can be protected from harm as effectively as possible.
6.7 If a Participant has apparent health problems, the Organizer is entitled to exclude them from the event. The Organizer reserves the right to charge a proportionate participation fee. The Participant may provide evidence that the costs incurred were lower.
6.9 Events and seminars, especially those held outdoors, always involve some residual risk. Participants are insured against accidents and rescue costs only to the extent covered by their own personal accident insurance.
7. Confidentiality
The Organizer undertakes to keep confidential all of the Participant’s/Client’s trade and business secrets during and after the event.
8. Liability
8.1 The Organizer is liable in cases of intent or gross negligence in accordance with statutory provisions. Liability for guarantees is independent of fault. In cases of ordinary negligence, the Organizer is liable only under the Product Liability Act, for injury to life, limb or health, or for breach of essential contractual obligations. However, compensation for an ordinary-negligence breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless liability arises from injury to life, limb or health. The Organizer is liable for the fault of its agents and representatives to the same extent.
8.2 The preceding paragraph (8.1) applies to damages in addition to performance, damages in lieu of performance and reimbursement of futile expenses, regardless of the legal basis, including liability for defects, delay or impossibility of performance.
9. Miscellaneous
Should any provision or part of a provision be or become invalid, the validity of the remaining General Exhibition Terms and Conditions and the contract with the Organizer will not be affected.
10. Place of Jurisdiction
The place of jurisdiction for all mutual obligations is Konstanz.
